Introduction

These Terms and Conditions explain the basis on which Majestic Wood Floors provides quotations, schedules work, supplies services and deals with customers through this website and in the course of business.

These terms should be read together with any quotation, booking confirmation or invoice we provide. The quotation sets out the agreed scope of works, deposit amount, any staged payments, and any job specific inclusions or exclusions.

If there is any conflict between a quotation and these website terms, the quotation will take precedence for that job.

Nothing in these terms removes or reduces any statutory rights available to a consumer.

The content on this website is provided for general information only. While we make reasonable efforts to keep information accurate and up to date, we do not guarantee that all content, descriptions, examples or guidance shown on the website will always be complete, current or suitable for every individual project.

Quotations, acceptance and variations

Any quotation, estimate or pricing guidance provided through the website, by email, by message or by phone is subject to review of the actual site conditions and final scope of works.

Unless stated otherwise in writing:

  • quotations are based on the information available at the time
  • anything not specifically included in the quotation is excluded unless later agreed in writing
  • quotations are valid for a reasonable period unless a different validity period is stated
  • all work is subject to availability and scheduling

The contract is formed when the customer accepts the quotation in writing or by another clear form of acceptance approved by Majestic Wood Floors, and any required deposit has been paid.

If the customer asks for additional works, changes to the specification, changes to the finish, changes to the layout, or changes to the timing of the works, we may issue a revised quotation or agree an additional charge and any necessary extension of time.

If hidden defects or unsuitable site conditions are discovered after work has started, we may pause the works and provide a revised quotation for any additional work required.

Booking and deposits

A deposit may be required and will be shown on the quotation.

A 30% deposit is required upon acceptance to confirm the booking. This secures the agreed dates and ensures the works are scheduled. The balance will be due on completion of each area.

For larger or staged projects, interim payments may be required if this is stated in the quotation.

We may pause work or withhold further attendance where amounts due under the quotation remain unpaid.

Access, site readiness and customer responsibilities

The customer must provide safe and reasonable access to the working area, including parking for one commercial vehicle where reasonably possible, together with a suitable electricity supply, lighting, and water access where required for the works.

Unless the quotation states otherwise, the working area must be fully cleared of furniture, personal belongings, floor coverings, building materials and other trades before work begins.

Unless specifically included in the quotation, we do not include the disconnection, moving or refitting of heavy appliances, sanitary ware, fitted units, kitchen islands, specialist furniture, or similar items.

The customer is responsible for identifying any visible or known pipes, cables, alarms, underfloor services or similar items in or across the working area. If these prevent progress on the agreed dates, additional charges for waiting time, extra visits or rescheduling may apply where reasonable.

Where building works are ongoing, sanding and finishing should normally be carried out after wet trades and dusty trades have finished and the area is ready to be protected and handed over.

Unless specifically included in the quotation, waste removal is limited to the tidy bagging of waste produced directly by Majestic Wood Floors during the works. Off site disposal is not included.

Timescales

Any timescales given are estimates only unless specifically confirmed in writing. Start dates and completion times may change due to site conditions, access issues, drying times, additional works, material availability, illness, weather, supplier delay, or other matters outside our reasonable control.

Materials and natural variation

Wood is a natural product and variation in colour, tone, grain, knots, texture and character is normal. Samples, display boards and photographs are guidance only and cannot represent every board or every finished result.

Goods which are made to measure, cut to size, batch matched, specially sourced, tinted, mixed, opened, moisture sensitive or otherwise ordered specifically for the job may be non returnable once ordered, mixed, opened or allocated to the works.

Where standard stock goods are accepted back by a supplier, any refund will be subject to the supplier’s return policy and any applicable collection, carriage, handling or restocking charges.

All goods supplied remain our property until paid for in full.

Sanding and restoration specific points

Sanding and restoration works are carried out to an existing floor. Not all defects, repairs, stains, movement, wear, unevenness, old fixings, previous coatings, adhesive residue or earlier workmanship can be fully removed or hidden.

Loose blocks, damaged boards, subfloor movement, deep staining, water damage, old repairs or other hidden issues may only become apparent once the floor has been opened up or sanded. If additional work is required, it will be discussed and, where necessary, quoted separately.

Professional dust extraction will be used wherever reasonably possible, but no sanding process can be described as completely dust free. A small amount of fine settling dust may still occur.

Reasonable care will be taken around skirtings, paintwork and adjoining finishes. However, where edges are tight, decorations are delicate, or previous finishes are fragile, minor disturbance or marking may occur as part of the normal process.

Where filling, patching or timber replacement is carried out, every effort will be made to achieve a close visual match. An exact match cannot be guaranteed and filler or repaired areas may move, settle, crack or become more visible over time because wood is a natural material.

Where stains, oils, tints or lacquers are selected, sample areas are guidance only. The final result may vary depending on timber species, age, previous exposure, absorbency, room lighting and other site conditions. Once a colour or finish has been approved and applied, later changes may result in extra cost.

Drying and curing times are estimates only and depend on temperature, humidity, airflow and product choice. The customer must follow all aftercare guidance, including waiting times before moving furniture back, laying rugs, cleaning, or allowing heavy use of the floor.

Supply and installation specific points

The property must be weather tight and reasonably ready for installation before the agreed start date. Wet trades should be completed and sufficiently dried out, and the environment should be suitable for timber flooring before materials are delivered or fitted.

Where acclimatisation is required, materials must be stored in suitable site conditions for the period reasonably advised for that product and project.

Unless the quotation states otherwise, the quotation assumes that the subfloor is suitable to receive the new floor covering. If moisture issues, weak screed, contamination, unevenness, insufficient preparation, movement or other defects are discovered, additional preparation may be required and charged separately.

Quotations are based on the measured area together with a reasonable allowance for cuts and normal wastage. Additional quantities may be required where there is pattern work, border work, difficult cuts, changes to the layout, or site conditions which could not reasonably be confirmed in advance.

Unless specifically included in the quotation, door easing, fire door works, threshold alteration, appliance adjustment, kitchen or fitted furniture alteration, and major changes to adjoining floor levels are not included.

Where materials are delivered to site before fitting, the customer must ensure they are stored in secure, dry and suitable conditions unless agreed otherwise in writing.

Payments

Payment terms will be set out in the quotation, invoice or other written agreement.

Unless otherwise agreed in writing, the customer must pay all sums due in full by the stated due date.

For business customers only, we reserve the right to charge interest and reasonable recovery costs on overdue invoices where legally permitted.

Cancellations, postponements and refunds

If the customer wishes to cancel or postpone the works, as much notice as possible should be given.

Any refund of sums paid will be assessed after deduction of losses reasonably incurred by Majestic Wood Floors as a direct result of the cancellation or postponement. These may include work already carried out, diary time that cannot reasonably be rebooked, goods ordered or committed specifically for the job, supplier restocking or collection charges, delivery charges, perishable or mixed products allocated to the job, and any other non recoverable costs properly incurred.

If the dates are postponed at short notice and the reserved time cannot reasonably be filled, we may charge a reasonable amount to reflect the resulting loss and any wasted attendance or rescheduling cost.

If we have to postpone or cancel because of events beyond our reasonable control, we will use reasonable efforts to agree a new date or refund any amount which is no longer properly due.

Where the customer is a consumer and the contract is made away from our business premises, or by email, telephone or online, statutory cancellation rights may apply. Where applicable, the information required by law will be provided with the quotation or booking confirmation.

Completion and snagging

The customer should inspect the works as soon as reasonably possible after completion and notify us of any genuine snagging items within 7 days.

Snagging does not include fair wear, accidental damage, damage caused by other trades or the customer after completion, changes caused by site conditions outside the recommended range, or matters which were outside the agreed scope of works.

Signing to confirm completion, or making normal use of the floor after completion, is acknowledgement that the works appear complete subject to any genuine snagging items promptly notified. This does not affect any statutory rights.

Photographs and marketing

Majestic Wood Floors may take photographs before, during and after the works for record keeping, quality control and marketing. Personal documents and identifying details will not be intentionally featured.

If the customer does not wish photographs of the property to be used for marketing, this should be stated in writing before the works begin.

Liability

We will carry out the works with reasonable care and skill.

We will not be responsible for delays or losses caused by events beyond our reasonable control, including supplier delays, severe weather, illness, accidents, site access problems, power failure, hidden defects, or unsuitable site conditions.

We will not be responsible for damage or movement arising from pre existing defects, natural timber movement, moisture or humidity outside the recommended range, building movement, leaks, actions of other trades, customer misuse, or failure to follow aftercare guidance.

For business customers only, we will not be liable for indirect or consequential loss, and total liability under the contract will not exceed the contract price, except for any liability which cannot legally be excluded or limited.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot legally be excluded or limited.

Changes to these terms

We may update these Terms and Conditions from time to time. Any changes will be posted on this page.

Governing law

These Terms and Conditions are governed by the law of England and Wales, and any disputes will be subject to the jurisdiction of the courts of England and Wales unless the law provides otherwise.
